A. Conditions and Terms of Use of this Web-Site

 

I. This web-site contains robot exclusion headers. The information and offers on this site are updated on a real-time basis. As a user of this site, you agree that you will not use any robot, spider, scraper or other automated means to access this site for any purpose without our express written permission.

II. You agree that you will not take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure.

III. You agree not to copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for your information or private use) from this web-site without the prior expressed written permission of Rodgau Philatelie and/or the appropriate third party, as applicable.

IV. You agree not to interfere or attempt to interfere with the proper working of this web-site or any activities conducted on this web-site.

V. You agree not to bypass our robot exclusion headers or other measures we may use to prevent or restrict access to this web-site.

 

 

B. Conditions and Terms of Sale

 

These Conditions and Terms of Sale are applicable to all transactions between Rodgau Philatelie and users of the web-site "hibernian-news.eu" in all circumstances.  The submission of an order (even verbally) is considerd implied and express acceptance of these Terms and Conditions of Sale.

I. Descriptions

a. All items offered here are offered subject unsold.

 

b. All items offered here are guaranteed i). correctly described, and ii). as genuine, unless specifically described as otherwise.

 

c. A buyer may decline acceptance of an item if the genuineness or the accuracy of the description is queried in writing within 7 days of receipt. The opinion of the appropriate BPP- or AIEP-Expertiser is considered final and binding. All expenses accrued to a lot due to expertising are to be paid by the person eventually retaining the item.

 

d. When a purchaser returns an item according to paragraph I.b, the purchase (+VAT if applicable), also any expenses as per paragraph I.b, will be refunded to the buyer.  Rodgau Philatelie or its owner(s) has no further liability.

 

e. No item may be returned which has marked or treated in any manner other than as defined in the BPP rules governing expertising, in its newest  version.  These can be viewed on the BPP web-site at  www.bpp.de

 

f.  No item described as a "collection", "mixed lot" or "accumulation", or which is offered "as-is" may be rejected by the buyer, and must be accepted with all faults or lack of genuineness, if any.  Collections, mixed lots and accumulations will NOT be sent "on approval".

 
 

II. Payment

a. All orders are to be pre-paid by means of cash (at buyer's risk), bank transfer, bank draft, credit card or by safe on-line transfer using PayPal.  As registered merchants we can also accept VISA and MasterCard directly, which will be processed manually.

 

b. To known and approved clients, and at the sole discretion of Rodgau Philatelie, items may be sent on 7 day's approval with invoice.

 

c. In the case of paragraph II.b, payment is due a maximum of 20 days after the invoice date. Overdue accounts are charged at 5% over the Bundesbank base lending rate calculated on a monthly basis + a €5 charge for each monthly statement or demand.  Until full, irrevocable payment has been received (value confirmed for checks and drafts, or past the charge-back date for credit cards), the sold material remains the sole property of Rodgau Philatelie.  For larger purchases, we offer an attractive extended-payment plan.  (Details on request)

 

III. Delivery

 

a. All items are sent by the most practical and economical means in accordance with postal regulations and within the limitations of our transit insurance.  See "Shipping & Handling" for details.  We do not understate the nett transaction value on Customs declarations.

b. If an item is proven to have been lost in transit, and the buyer has already paid for the item, the purchase price of the item will be refunded by Rodgau Philatelie to the buyer.  Liability for loss or damage is limited to the invoice value of the item in question.  Rodgau Philatelie has no further liability. The lost item, if subsequently recovered, remains the sole property of Rodgau Philatelie.

 
 

IV. Jurisdiction

 

a. Buyers using this site have statutory rights and rights of return as defined by the European Distance Selling regulations which apply for all sales of philatelic items, stamps, albums and accessories, as well as for coins made of ferrous and other non-precious metals.

 

b. According to paragraph 312d, section 4, No.6 of the German Distance Selling Laws, the buyer does not have the right to withdraw from a contract involving the sale of items where the price is subject to daily fluctuations of the financial markets beyond the control of the seller.  For coins made of gold, silver, platinum or palladium, supplied as bullion or investor coins, the buyer's rights of return in accordance to the Distance Selling Laws are restricted.

 

c. The Court of Jurisdiction is Seligenstadt in the State of Hesse.  For buyers within Germany, only the Laws of the Federal Republic of Germany apply.  For buyers from outside Germany, the European Laws governing Distance Selling apply.  In the case of breach of contract, Rodgau Philatelie may chose to pursue the fulfillment of obligations through the legal seat of residence of the buyer.
